Terms of Service

1. Acceptance of Terms

By creating an account or using Senior Check-In (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are accepting on behalf of a family member or other individual, you represent that you have authority to bind them as well. If you do not agree to these Terms, do not use the Service.

2. The Service

Senior Check-In provides automated daily outbound telephone check-ins to elderly adults enrolled by their family members. After each call, a wellness summary is delivered by email to the enrolling family member. If a senior cannot be reached after repeated attempts, an escalation alert is sent by email.

The Service is a wellness and communication tool. It is not a medical device, emergency response service, or substitute for professional care. In an emergency, call 911.

3. Account Registration

To use the Service you must provide accurate information during onboarding, including a valid email address and a phone number for the senior being enrolled. You are responsible for maintaining the accuracy of this information and for all activity that occurs under your account.

You must be at least 18 years old to register. By enrolling a senior, you confirm that you have their consent (or the consent of their legal guardian) to receive daily check-in calls and for call data to be processed as described in our Privacy Policy.

4. Free Trial

New accounts include a 7-day free trial. No credit card is required to start your trial. At the end of the trial period, continued use of the Service requires a paid subscription. We will notify you by email before your trial expires.

5. Billing and Payment

The Service is billed at $30 USD per month following the free trial period. Billing is monthly and recurs on the same day each month. All fees are non-refundable except as required by law or as explicitly stated in these Terms. We use a third-party payment processor; your payment information is subject to their terms and is not stored on our servers.

If a payment fails, we will attempt to notify you by email and may suspend the Service until payment is received.

6. Cancellation

You may cancel your subscription at any time from your account settings or by emailing us. Cancellation takes effect at the end of the current billing period; you will continue to receive service through that date. We do not issue partial-month refunds.

7. Acceptable Use

You agree not to:

  • Provide false or misleading information during enrolment
  • Enrol a senior without their knowledge or consent
  • Use the Service for any purpose other than personal family wellness
  • Attempt to reverse-engineer, scrape, or abuse the Service infrastructure
  • Resell or sublicense access to the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms.

8. Call Recording and Consent

Check-in calls may be recorded and transcribed to generate wellness summaries. Depending on your jurisdiction, recording a phone call may require the consent of all parties. By enrolling a senior, you confirm that you have obtained any consent required by applicable law. We present a consent disclosure during onboarding; proceeding past that step constitutes confirmation of consent.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CALLS WILL ALWAYS BE SUCCESSFULLY PLACED.

SENIOR CHECK-IN IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES, MEDICAL CARE, OR IN-PERSON SUPERVISION. NEVER DELAY SEEKING EMERGENCY ASSISTANCE BASED ON THE STATUS OF A CHECK-IN CALL.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SENIOR CHECK-IN AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Changes to the Service or Terms

We may modify these Terms or the Service at any time. We will provide at least 14 days' notice by email before material changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you may cancel your account before they take effect.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
